EMC maps OpenStreetMap legal use?

EMC maps uses {a,b,c}.tile.openstreetmap.org. Is it legal to use?

In the OSMF Tile Usage Policy:

https://operations.osmfoundation.org/policies/tiles/

you can find:

"Heavy use (e.g. distributing an app that uses tiles from openstreetmap.org) is
forbidden without prior permission from the System Administrators."

OSMF defines heavy use as: distributing an app that uses tiles from openstreetmap.org

So I think it's forbidden without a permission.
