This depends on your service level. If you do not have a service level then you can only get the level of code that was out when you ordered your equipment. I would call TAC and see if they can help diagnose the issue it will be the fastest resolve time.
running the diagnostics should show any HW issues. If the switch is still in default just do a show vlan default or show default and see if the ports are enabled. they will have a ! if they are disabled.
If they are enabled then I would recommend opening a TAC request. The 440 has LLW that will replace the HW if it is bad.
