Software based ELRP uses the CPU for processing the packets. If the switch is under load, these packets may be de-prioritised in favour of real world packets, so the switch under unusual circumstances may miss either sending or receiving and miss a loop. Haven't seen this happen in 15 years of using software based ELRP on very large networks, but it could happen.
Hardware assist uses the Network Asics, which as you say, wastes a port, however packet send/receive is guaranteed.
